Terms of use
Version: beta 1 · Effective from: [date of publication]
1. Who we are
Fog Atlas is run by Controlled Chaos BV, a company registered in Belgium:
- Address: Wilselsesteenweg 349/1, 3010 Leuven, Belgium
- Company number: BE 0730.857.188
- Contact person: Maarten Peeters
- Email: hello@fogatlas.online
In these terms "we", "us" and "our" mean Controlled Chaos BV. "You" means a game master ("DM") with a Fog Atlas account. Section 9 covers players.
2. The beta
Fog Atlas is in a free, invite-only beta.
- Free. We do not charge for the beta. If we ever introduce paid plans, we will tell you by
email at least 30 days before a paid plan starts. Nothing will be charged without your explicit agreement.
- Invite-only. You can only create an account with an invitation from us. An invitation is
personal; do not pass it on.
- "As is". The beta is a work in progress. It is offered "as is", so features may have
bugs, change, break or disappear. There is no guaranteed uptime and no guaranteed support. Keep your own copies of anything that matters to you, using the export.
- It may change or end. We may change the service at any time. Before the beta ends, or before
a paid plan starts, we will tell you by email at least 30 days in advance, so you can export your data. In an emergency (for example a security problem) we may have to act without notice.
Support is by email at hello@fogatlas.online. We aim to answer within one day. During the beta there is also a group chat for beta DMs on game nights; what you post there falls under the chat service's own terms.
3. Your account
- You must be 16 or older.
- Give a real email address. We use it for your login and for messages about your account.
- Keep your password to yourself. You are responsible for what happens under your account.
- One account per person.
- Tell us at hello@fogatlas.online if you think someone else has used your account.
4. Your content
- You own what you create. Your worlds, maps, adventures, notes and uploads stay yours.
- You give us permission to store, copy, process, display and back up your content, only to
run Fog Atlas for you and for the players you share it with. This permission ends when you delete the content or your account (subject to the backup period in the Privacy Policy).
- You must have the right to everything you upload. Do not upload art, maps or rulebook text you
are not allowed to use.
- We do not look at your content, except where needed to keep the service running, fix a problem
you report, or comply with the law.
5. Your players and their data
Players join your game through a private link. They do not need an account. A player link stops working after 90 days, or sooner if you revoke it.
You decide what goes into your game, including information about your players (names, notes, images). For that information you are responsible, and we store it on your behalf. We offer you a processor agreement built on the European Commission's standard contractual clauses for processors (Implementing Decision (EU) 2021/915), covering how we handle that data. The processor agreement is linked from these terms; you accept it when you create an account. The beta welcome email repeats the link.
You agree to:
- only put in what you need to run your game;
- tell your players that you use Fog Atlas, and point them to the Privacy Policy;
- if a player asks you to correct or remove their information, do so (the app lets you);
- not record anyone without their consent. Fog Atlas's session recorder runs on your own computer
and will not start until you record everyone's consent. Those recordings are yours to look after;
- get a parent's or guardian's permission where needed if a player is a child.
6. Acceptable use
Do not use Fog Atlas to:
- break the law, or store or share illegal content;
- infringe anyone's copyright or other rights;
- harass, threaten or harm anyone;
- get around access controls, including what a DM has hidden from players, or another DM's data;
- overload, scrape, probe or attack the service;
- share your account or invitation with others.
7. Suspension and ending your account
- You can delete your account at any time in your account settings. You can export all your
data first, at any time, as a single archive file from your account settings.
- We may suspend or close your account if you seriously or repeatedly break section 6, or if we
must for legal or security reasons. Where reasonable we will warn you first and give you a chance to export your data.
- When an account is deleted, its data leaves the live database immediately and leaves the backups
within 90 days.
8. Liability
Controlled Chaos BV is liable to you as Belgian law provides.
Nothing in these terms limits our liability for intent or gross negligence, or for anything that consumer law does not allow to be limited. Nothing in these terms affects your mandatory rights as a consumer.
The beta is offered as is: features may change or break. Keep your own copies of anything that matters to you, using the export.
9. Players
If you are a player who opened a DM's link: you do not need an account and you do not accept these terms by playing. Please do follow section 6. Your DM decides what is in the game. The Privacy Policy explains how your data is handled and who to ask.
10. Rules content and licences
Fog Atlas includes material from the System Reference Document 5.1 ("SRD 5.1") under the Creative Commons Attribution 4.0 International licence (CC-BY-4.0); the required notice is on the Licences page of the app.
Fog Atlas is not affiliated with, endorsed by, or sponsored by Wizards of the Coast. The licence above covers the rules text only. It gives no right to use Wizards of the Coast's trademarks.
11. Privacy
How we handle personal data is explained in the Privacy Policy at [URL].
12. Changes to these terms
We may update these terms. We will post the new version here with a new date. For important changes we will email you at least [30] days in advance. If you do not agree, you can export your data and delete your account before the change takes effect.
13. Law and disputes
Belgian law applies. If you live in another EU country, you keep the protection of the mandatory consumer law of that country.
Please contact us first at hello@fogatlas.online; we will try to solve any problem informally. If that does not work, the courts of Leuven, Belgium, are competent, unless consumer law gives you the right to go to the court where you live.
